The Court could use the case to make a broad doctrinal statement that public schools may not pursue racial diversity indirectly through proxies designed to achieve racial outcomes. This would be the most consequential outcome for school districts in Maryland, Virginia, New York, California, and Massachusetts that use race-neutral redesigns for selective programs.
